Privacy statement

This privacy statement explains which personal data we process when you visit our website www.foxtrading.eu and when you contact us, for what purposes and on what legal basis, and which rights you have. Our offer is aimed exclusively at business customers. The data subjects are therefore mainly visitors to the website and contact persons at our customers, prospective customers and suppliers. In case of doubt, the German version shall prevail.

2. Summary

We do not use cookies for visitors, analytics or tracking services, advertising networks or social media plugins on our website. Fonts and all other content are loaded from our own web space; we do not use Google services. We only process personal data where this is necessary to operate the website, to handle your enquiry or for our business relationship. A map from OpenStreetMap is only loaded if you explicitly click to show it (section 6).

3. Hosting and server log files

Our website and our email mailboxes are hosted by IONOS SE, Elgendorfer Straße 57, 56410 Montabaur, Germany. IONOS processes the data on our behalf and in accordance with our instructions (data processing on behalf of the controller pursuant to Art. 28 GDPR).

When you visit our website, your browser automatically transmits technical information that is stored in server log files: IP address, date and time of access, page or file requested, amount of data transferred, status code, the previously visited page (referrer) as well as browser type and operating system. This processing is necessary to deliver the website, to ensure its stability and security and to defend against attacks. The legal basis is our legitimate interest pursuant to Art. 6(1)(f) GDPR. The log files are not combined with other data and are automatically deleted or anonymised after the hosting provider’s short retention period.

4. Encryption

For security reasons, our website uses TLS encryption. You can recognise an encrypted connection by “https://” in your browser’s address bar. This means that the data you transmit to us cannot be read by third parties.

5. Contact form and contact by email

If you write to us using the contact form, we process the details you provide (name, company – optional –, email address, subject and message) in order to handle and answer your enquiry. Mandatory fields are marked; without this information we cannot process your enquiry.

Your enquiry is not stored in the website’s database but is sent by email via the IONOS mail server to our mailbox. To protect against misuse (automated mass enquiries), we store a pseudonymised value derived from your IP address for a maximum of one hour; the IP address itself is not stored. Instead of an external “captcha” service, we use a simple arithmetic question.

The legal basis is Art. 6(1)(b) GDPR where your enquiry relates to the conclusion or performance of a contract, and otherwise our legitimate interest in answering enquiries (Art. 6(1)(f) GDPR). The same applies if you contact us by email.

We delete your enquiry once it has been fully dealt with, provided that no statutory retention obligations apply. If your enquiry leads to a business transaction, we retain the correspondence in accordance with German commercial and tax law (generally six or ten years, section 257 HGB, section 147 AO).

6. Map display (OpenStreetMap)

On our contact page you can display a map of our location. The map is only loaded once you click “Show map”. Only then does your browser connect to the servers of the OpenStreetMap Foundation (OSMF), St John’s Innovation Centre, Cowley Road, Cambridge, CB4 0WS, United Kingdom. In particular, your IP address, information about your browser and the map section displayed are transmitted to the OSMF; the OSMF may also use cookies or similar technologies.

The legal basis is the consent you give by clicking (Art. 6(1)(a) GDPR, section 25(1) TDDDG). Your consent only applies to the respective page view; the map is not loaded again automatically. An adequacy decision of the European Commission exists for the United Kingdom (Art. 45 GDPR). Further information can be found in the OSMF privacy policy.

7. Business relationships with customers and suppliers

Within our business relationships, we process data of our contact persons at customers, prospective customers and suppliers, in particular name, position, business contact details as well as quotation, order, delivery, invoice and payment data. This is done to initiate and perform contracts (Art. 6(1)(b) GDPR where the data subject is a party to the contract, otherwise Art. 6(1)(f) GDPR) and to comply with legal obligations such as commercial and tax retention obligations (Art. 6(1)(c) GDPR).

Where necessary, we pass on data to parties we use for processing orders, e.g. banks for payment transactions, parcel services and freight forwarders for shipping, our tax adviser and our hosting and email provider IONOS. We only send current offers to business customers by email if they have consented or if this is permitted under section 7(3) of the German Act against Unfair Competition (UWG); you can object to this at any time.

8. Cookies

When you visit our website, no cookies are set and no information is stored on or read from your device that is not technically required for the page you have requested. A cookie banner is therefore not necessary. WordPress only sets technically necessary cookies when logging in to the editorial area, which is accessible to our staff only. For the OpenStreetMap map, see section 6.

9. Recipients and transfers to third countries

Your data is only transferred to third parties in the cases described in this privacy statement or where we are legally obliged to do so. Data is only transferred to countries outside the EU or EEA if you load the OpenStreetMap map (United Kingdom, see section 6). There is no automated decision-making, including profiling.

10. Your rights

Subject to the statutory requirements, you have the right of access (Art. 15 GDPR), rectification (Art. 16 GDPR), erasure (Art. 17 GDPR), restriction of processing (Art. 18 GDPR) and data portability (Art. 20 GDPR). You can withdraw any consent you have given at any time with effect for the future (Art. 7(3) GDPR).

Right to object: Where we process data on the basis of legitimate interests (Art. 6(1)(f) GDPR), you may object at any time on grounds relating to your particular situation (Art. 21(1) GDPR). You may object to processing for direct marketing purposes at any time without giving reasons (Art. 21(2) GDPR).

To exercise your rights, simply send a message to legal-entfernen-@foxtrading.invalid.eu. You also have the right to lodge a complaint with a data protection supervisory authority (Art. 77 GDPR). The authority responsible for us is the State Commissioner for Data Protection and Freedom of Information of North Rhine-Westphalia (LDI NRW), Kavalleriestraße 2–4, 40213 Düsseldorf, Germany.
